Intentional Practice Owner’s Circle – Payment Terms Services

By purchasing access to the Intentional Practice Owner’s Circle available on our website, you agree to be provided with products, programs, and/or services by us and that you are entering into a legally binding agreement (the “Agreement”) with us, subject to the following terms and conditions. In accordance with these terms and conditions, we agree to provide services in accordance with our listed group coaching program. The scope of services rendered by us pursuant to these terms will be solely limited to those contained therein and/or provided for on our website as part of the program. We reserve the right to substitute services equal to or comparable to the program for you if reasonably required by the prevailing circumstances. The membership includes the following:

  • 4 live video calls per month (one intention setting call, one mastermind call, one co-working call, and one accountability call), each 45 minutes in length, using the platform designated. We reserve the right to change these session offerings as needed.
  • Access to the any supporting materials and resources provided in the vault
  • A private online, virtual group for support, questions, accountability and connection to us and group members
  • The opportunity to apply for 30 minute blocks of individual coaching at a reduced rate based on your payment contract.  Rates for individual coaching are subject to yearly increase.
  • Calls will be recorded and available for Collective members to watch inside the member portal and will typically be available within 48 hours of the session.
  • Participating in a live call provides your consent for this information to be shared within the portal and viewed by any current or future members of the group. 

 

Recordings: You understand that all parts of the program, including in-person and virtual events, may be filmed, videotaped, audio taped, or photographed. Unless otherwise agreed to, by participating in our program and related events, you grant us the right to use and publicize your name, image, and voice for educational, marketing, and promotional purposes without compensation and without opportunity for review.

 

Term: You will retain access to the program for the life of the program, meaning for as long as we offer and maintain the program, provided you have paid in full and make your membership payments on time. We will provide you with at least three month’s notice should we need to retire the program. It is then your responsibility to download all materials from the program before the retirement date noted by us. 

 

Outcomes and Methods: You agree to be open-minded to our methods and partake in methods proposed, to include receiving coaching and guidance from guest speakers, other participants, and consultants. You understand that we have made no guarantees as to the outcome of the coaching sessions or program. We may revise methods or parts of the program based on the needs of clients or as deemed necessary in our opinion. 

 

Success Not Guaranteed: By accepting the terms of this Agreement, you agree and understand that our programs do not guarantee any specific result. You take responsibility for your own success. 

 

Disclaimer: By participating in our program, you acknowledge that we — and any of our affiliated guest speakers and consultants — are not legal or health professionals or the like. In the event that one of our coaches, guest speakers or consultants does hold a professional designation or license, you understand that any information provided should be considered a general recommendation or suggestion and not specific advice catered to your specific situation. You acknowledge that, unless specifically stated otherwise, we and our affiliated guest speakers and consultants are not legally qualified, are not a substitute for advice from a qualified professional, do not warrant the accuracy of any information provided, and are not liable for any losses you may suffer by relying on communicated advice. 

Payment and Refund Policy: Upon execution of this Agreement, you agree to pay the full purchase amount, made in monthly or yearly payments. The fee for the program is nonrefundable. We want you to be fully committed. If you select a payment plan option, you agree to pay fees to us according to the payment schedule set forth on our website, or otherwise provided to you, and the payment plan you selected. In the event that you fail to make any of the payments within a payment plan during the time prescribed, we have the right to immediately disallow participation until payment is paid in full, including disallowing access to modules, materials, and coaching calls or sessions. If you do not commence payment after 30 days, we have the right to terminate the Agreement. 

Affiliates: This page may make use of affiliate marketing.
From time to time, we promote, endorse, or suggest products or services of others. In most cases, we will be compensated – either as an affiliate with a commission based on sales, or with a free product to review or use. Our recommendations are always based on (i) our personal belief in the high quality and value of the product or service, and (ii) our review of the product or service, or a prior relationship or positive experience with the sponsoring person or organization.  We are a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for us to earn fees by linking to Amazon.com and affiliated sites.

Assignment
The Dwyer Psychological Services, PC is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

Entire Agreement
These Terms constitute the entire agreement between Dwyer Psychological Services, PC and you in relation to your use of this Website, and supersede all prior agreements and understandings.

Governing Law & Jurisdiction
These Terms will be governed by and interpreted in accordance with the laws of the State of Colorado, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Colorado for the resolution of any disputes.
